Three defendants jointly paid RMB 300, 000for trademark infringement upon “MIQUEL”

MIQUEL (Tianjin) Development Co., Ltd. sued Spain MIQUEL (Hong Kong) Manufacturer Group Co., Ltd. and its distributors for trademark infringement and unfair competition. On December 1,2005, Tianjin No. 1 Intermediate People’s Court (the “Court”) rendered the judgment in favor of the Plaintiff. The Court recognized the combination of “cattle head device and米盖尔(Miquel in Chinese characters)”, the combination of “MIQUEL and cattle head device” and “MIQUEL” as well-known trademarks in China. The Court held that the alleged unfair competition and trademark infringement are established and ordered in the first instance the three defendants to pay RMB 300,000 jointly to the Plaintiff as compensation of damage.
