Unitalen Won Domain Name Dispute on behalf of Robert Bosch GmbH

November 7, 2006
Subsequent to a successful case on domain name dispute of “bosch.cn”, Unitalen won another case on behalf of Robert Bosch GmbH again, which related to the domain name “boschchina.com” in dispute. After examination, the Administrative Experts Group of Asian Domain Name Dispute Resolution Centre (ADNDRC) finally accepted the opinion lodged by lawyers from Unitalen and held that the domain name “boschchina.com” in dispute has a dominant part of “bosch” which is a registered trademark owned by the plaintiff, resulting in confusingly similarity between the domain name and the plaintiff’s registered trademark, and that the defendant does not enjoy any right and legal interests of the domain name in dispute and that the defendant registered the domain name in bad faith. Based on the above, the ADNDRC made a ruling that the defendant shall assign the domain name in dispute to the plaintiff. This successful case made many famous enterprises in trouble in connection with disputes on domain name see hope again.
