Supreme Court Delegates Jurisdiction of Intellectual Property Cases

The Supreme People’s Court and Jiangsu High People’s Court confirmed recently that five grassroots-level courts in the province have the right to hear the part of civil disputes concerning intellectual property.

From December 1, 2008, on the Wujin District Court and Tianning District Court of Changzhou began to accept civil cases concerning intellectual property with damages under 1 million Yuan, with the exception of cases involving patents, new plant species, integrated circuit design and those involving Hong Kong, Macau or Taiwan affairs as well as the recognition of well-known trademarks. Since the Gaoxin District Court started to accept IP cases in July 2007, Changzhou has had three local courts for civil lawsuits pertaining to intellectual property.

The additional three courts are; the Binhu District Court of Wuxi City, the Court of Yixing City, and the Court of Zhenjiang Economic Development Zone.
